Obama vents frustration at Senate delays

Barack Obama on Wednesday expressed frustration with the way the Senate does business, saying the use of delaying tactics there harms the nation’s ability to “deal with big problems in a very competitive world.”
“Other countries are going to start running circles around us,” Obama said in a White House interview with PBS. “We’re going to have to return to some sense that governance is more important than politics inside the Senate.”
Obama’s critique of his former Senate colleagues came just as his allies there were on the cusp of giving him what he wants: passage of a Senate health care bill.
The bare-minimum bloc of 60 senators—all 58 Democrats and two independents—voted to end a GOP filibuster and move toward final passage Thursday.

Sens. Jim DeMint (R-S.C.) and John Ensign (R-Nev.) are questioning the constitutionality of the Democrats’ Senate version of the healthcare bill. On behalf of the Republican Steering Committee, the official caucus of conservative senators, the two raised on the Senate floor yesterday a Constitutional point of order that will compel a vote by the full Senate today on the bill’s constitutionality.
The point of order will either be waived — by Democrats who don’t care about the constitutionality or are willing to ignore the issue — or it will stand and the healthcare bill will be dead until the unconstitutional parts are excised.
Likely part of the planned series of votes today around 2:00 pm, the Senate chair will not rule on the bill’s constitutionality, so the matter will be placed before the full Senate to ask if the point is “well taken.” It takes a simple majority to agree that the bill is unconstitutional.
The Congressional Budget Office once stated “A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action. The government has never required people to buy any good or service as a condition of lawful residence in the United States.”
The bill requires every American citizen to buy health insurance “whether or not they ever visit a doctor, get a prescription or have an operation.” If a citizen chooses not to buy health insurance coverage, they will face a fine that will quickly increase to $750 or 2% of their taxable income, whichever is greater.
The senators say the individual mandate likely also violates the “takings” clause of the 5th Amendment.
“I am incredibly concerned that the Democrats’ proposed individual mandate provision takes away too much freedom and choice from Americans across the country,” Ensign said. “As an American, I felt the obligation to stand up for the individual freedom of every citizen to make their own decision on this issue. I don’t believe Congress has the legal authority to force this mandate on its citizens.”
The Heritage Foundation legal study concluded: “An individual mandate to enter into a contract with or buy a particular product from a private party, with tax penalties to enforce it, is unprecedented — not just in scope but in kind –and unconstitutional as a matter of first principles and under any reasonable reading of judicial precedents.”
“This is one way we can be true to what the American people want us to do,” DeMint continued in the exclusive interview. “They keep asking, ‘What about the Constitution?’ I see it everywhere I go. There’s nothing in the Constitution about the government running our health care system. It seems obvious from the content in several places in the Constitution that showing any kind of preferential treatment at the federal level for states or persons is not constitutional. When we see like what’s going on in Nebraska or Louisiana — it’s a clear violation of the Constitution on that front.”
What does DeMint hope to accomplish with the vote?
“What I hope we can do by raising the point of order is to maybe turn our focus back to our oath of office and the whole foundation that we are supposed to be making laws from, which is completely un-tethered now,” DeMint said.
“There is no mention of constitutional framework now when we deal with legislation. As I said [Monday] on the floor, most of the people here in this Congress believe that there is not a pothole in America today that should not be filled with a federal earmark — or a scratched knee or a hurt feeling. I mean there’s nothing that can be brought up on the floor of the Senate that people could say, ‘That’s not constitutional,’ and be taken seriously. In fact it’s gone the other way. If you have the audacity to suggest that the government shouldn’t do something — you are accused of not wanting it to be done. We have to break that pattern. And part of it with this bill that’s now become very high profile, if we raise a Constitutional Point of Order, get people thinking about it, my hope is if the thing does go through, and I’m going to fight to the end to stop it, but if it does go through that there are constitutional challenges to this thing for years.”

I watched it this morning and the bill passed. Now the American People get the shaft.
Not yet Bob, it still has to go to reconciliation. There is still a glimmer of hope, real hope that the extreme Libs and Stupak get their dander up. Another blue dog is talking about switching sides, there still some fight left in this thing.

The Constitution is a nuisance to the Democrats(socialists). It seems that they happily violate The Constitution. We the People lose every time the Democrats violate the Constitution, the framework of govt restrictions.
In case ya all missed it, the reason for canceling breast cancer screening in California was due to reduced revenues from tobacco, soon it will be a national reduction of revenue from reduced taxes due to no jobs. Of course we can rely on the United Nations to help us out like they have in the past.
