Judge Will Let DOJ Suit Against Arizona Proceed
From the Courthouse News Service, a federal district judge has rejected a motion to dismiss the suit brought by the Obama Justice Department against the state of Arizona:
PHOENIX (CN) – A federal judge rejected motions in which Gov. Jan Brewer, Maricopa County Sheriff Joe Arpaio and Pinal County Sheriff Paul Babeu sought dismissal of a lawsuit challenging the constitutionality of Arizona’s new immigration law.
The complaint filed by civil rights groups, including Friendly House and the American Civil Liberties Union, contains sufficient allegations that S.B. 1070 perceptibly impairs the ability of the organizational plaintiffs to provide the services that the organizations were formed to provide, and as a result, there can be no question that the organizations have suffered an injury in fact, U.S. District Judge Susan Bolton ruled.
“While Governor Brewer correctly points out that, for the most part, the organizational plaintiffs’ allegations involve threats of future harm, the threat of future harm is sufficiently imminent.”
Bolton found the civil rights groups have standing to bring the lawsuit because the “alleged harm to the organizational plaintiffs will occur if S.B. 1070 goes into effect, regardless of how it is enforced or applied.”
Bolton wrote that “race, alienage, or national origin discrimination was a motivating factor in the enactment of S.B. 1070.”

1 ( ILLEGAL ) arrested after man found decapitated in Chandler, AZ.
CHANDLER, AZ - Police are looking for three additional suspects after a man was found stabbed and decapitated inside a Chandler apartment and a nearby resident was arrested in connection with the slaying.
A police statement issued on Monday says officers were called to the apartment about 5:30 a.m. the previous morning.
After discovering the slain man, detectives began an investigation and eventually arrested 36-year-old Crisantos Moroyoqui. He was arrested on suspicion of second-degree murder and hindering prosecution.
The victim is a man in his 30s. His name is being withheld until his family is notified.
Police are now asking for the public's help to locate three men, Juan Campos Morales Aguilar, Jose David Castro Reyes, and a man known only as "El Joto", also suspected in the attack.
Aguilar is described as a Hispanic male, 5 feet 10 inches tall, 220 pounds, with short dark hair and a thin mustache. He was seen wearing a black shirt, white t-shirt and jeans.
Reyes is also a Hispanic male, 5 feet 10 inches tall, 180 pounds with short hair and a clean-shaven face. He was last seen wearing a white shirt, white t-shirt and blue jeans.
The third suspect is a Hispanic male, between 5 feet 2 inches and 5 feet 4 inches tall, thin build with short spiked black hair and a goatee. He was last seen wearing a white t-shirt with a black pattern shirt and Levis.
Chandler police say the three suspects are believed to be traveling in a red 2003 Ford Expedition with California license plate 6FWR784.
Anyone with information about the suspects' whereabouts is urged to contact 911. The men are considered to be armed and dangerous.
Police arrested a Chandler resident Sunday after discovering a decapitated man inside an apartment. Crisantos Moroyoqui, 36, faces one charge of second-degree murder and hindering prosecution.
Det. Frank Mendoza said Moroyoqui was booked Sunday and was not cooperating with the investigation.

So, the decision is based on some judge's personal assumption, not an interpretation of the Constitution. When this nation finally falls, activist judges will bear a very large part of the blame. I am totally fed up with the assault on our rights and our country.

Gee..ya think?? Our corrupt government in Washington D.C. won’t do anything about heinous acts like this until it happens in the very halls of Congress.......and then I wonder.
Pathetic. Elsewhere in Bizarro-land, the Ft. Hood shooter trial gets yet another delay - until Nov. 9th!

The American Federal legal system. Clumsy, flawed, unrealistic, opinionated, politicized. It seems to take forever to get a Federal trial underway. I think it is a mistake that Federal judges are given lifetime appointments. That removes the incentive to rule in a totally unbiased manner.

It boggles the mind how this "Civil Rights" issue is used to apply to a law that is designed to prevent further Illegal Immigration. The word "Illegal", in itself abrogates any Rights, Civil or otherwise.
I am aware that this Activist Judge, is looking out for the actual citizens, who might fall under suspicion. If you have proper ID and certification then you have no problem.
I would be willing to bet that the majority of Americans of Hispanic Heritage are dead set against Illegal Immigration, because of the position that it puts them in. Their Civll Rights are not being violated by this law, they are being violated by the Illegals attempting to enter this country.
The Government is so far off base with this lawsuit, just as they have been on almost every issue since Obama took office.

All these Clinton appointees are paying back the liberal/progressive system. They don't care about what the law says just give away as much of the country as they can. In an attempt to create their perverted idea of utopia, which is always unachievable. To punish the white Europeans. Come November there will be a new Sheriff to treat with.
